3. Estimates and Pricing

If you need to cancel or reschedule a non-emergency service appointment, please contact us as soon as possible. Cancellations made after a crew has been dispatched may result in a trip charge to cover fuel and labor costs already incurred.

For emergency services, we dispatch as quickly as possible. Response times are estimates only and are not guaranteed. We are not liable for delays caused by traffic, road closures, weather, or other circumstances outside our control.

5. Payment Terms

Payment is due upon completion of services unless a prior written agreement (such as a fleet account or purchase order) is in place. We accept payment by cash, major credit cards, and other methods as specified at the time of service. Customers are responsible for all charges incurred, including any applicable fees for permits, storage, or after-hours service.

Vehicles in storage will accrue daily storage fees. Storage fees begin on the day the vehicle is received and are charged for each calendar day (or portion thereof) the vehicle remains in our care. You will be notified of applicable storage rates at the time of service or upon inquiry.

Vehicles may be subject to a lien if storage fees and outstanding charges are not paid in a timely manner, in accordance with California law.

6. Customer Responsibilities

By requesting our services, you represent and warrant that:

• You are the owner of the vehicle or have authorization from the owner to request towing or recovery services.
• The information you provide about the vehicle and situation is accurate to the best of your knowledge.
• You will remain accessible by phone during the service or designate a representative who can make decisions on your behalf.
• You will not attempt to move or interfere with a vehicle once a recovery crew has begun work.
• You will disclose any known hazards associated with the vehicle, including fuel leaks, hazardous cargo, or structural instability.

7. Limitation of Liability

San Pablo Heavy Duty Towing will exercise reasonable care in providing towing and recovery services. However, to the fullest extent permitted by applicable law, we are not liable for:

• Pre-existing damage to vehicles that was present before services were rendered.
• Damage caused by the vehicle being inoperable, structurally compromised, or in an unsafe condition at the time of towing.
• Loss of personal property left in a vehicle.
• Delays resulting from traffic, weather, road closures, or other events outside our control.

If you have a dispute with San Pablo Heavy Duty Towing regarding our services or these terms, we encourage you to contact us first so we can try to resolve the issue directly.

If we cannot resolve the dispute informally, you agree to submit the dispute to binding arbitration conducted by a neutral arbitrator in San Pablo, CA, under the rules of the American Arbitration Association (AAA), unless both parties agree otherwise in writing. The decision of the arbitrator shall be final and binding.

You waive the right to participate in any class action lawsuit or class-wide arbitration related to any claim under these terms.
